Copyright Infringement Policy
Overview
The Digital Millennium Copyright Act of 1998 (the "DMCA") provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that materials appearing on this site, www.handbid.com (the "Site"), infringe your copyright, you (or your authorized agent) may send Handbid, Inc. ("Handbid," "we," "us," or "our") a written notice requesting that the material be removed or that access to it be blocked.
1. Requirements for a Valid Copyright Infringement Notice
To be valid under the DMCA, your written notice must include all of the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or — if multiple copyrighted works at a single online site are covered by a single notification — a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, together with information reasonably sufficient to permit us to locate the material. Direct URLs to the specific content or images referenced are required.
- Information reasonably sufficient to permit Handbid to contact you, such as your name, mailing address, telephone number, and, if available, an email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and made under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Counter-Notice Procedure
If you believe in good faith that a notice of copyright infringement has been wrongly filed against material you posted, the DMCA permits you to send Handbid a counter-notice. Notices and counter-notices must meet the statutory requirements imposed by the DMCA.
You acknowledge that if you fail to comply with all notice requirements of the DMCA, your notice may not be valid.
For more information on the DMCA requirements, visit the U.S. Copyright Office website at http://www.copyright.gov.
3. Designated DMCA Agent
All written Notifications of Claimed Infringement must comply with Title 17, United States Code, Section 512(c)(3)(A) and must be submitted to our designated DMCA agent:
Handbid, Inc. Attention: DMCA Compliance Officer 9200 E Mineral Ave #350 Centennial, CO 80112 USA Email: dmca@handbid.com
4. Repeat Infringers
In accordance with the DMCA and other applicable law, Handbid has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights.
5. No Legal Advice
Nothing in this policy constitutes legal advice. If you are uncertain whether material on the Site infringes your copyright, or whether you have grounds for a counter-notice, we recommend consulting a qualified attorney.
