Acceptable Use Policy

Introduction

This Acceptable Use Policy ("AUP") governs the use of the Handbid platform and services by sellers and auction managers ("you"). By using the Handbid Services, you agree to be bound by this AUP. Handbid does not participate in actual transactions between sellers and bidders, but reserves the right to enforce this policy to protect the integrity of the platform and its users.

1. Content Descriptions and Accuracy

  • All auction content must be described truthfully and accurately, including text, images, condition, age, authenticity, and provenance.
  • Any damage, wear, modifications, or defects must be photographed and clearly disclosed in the listing.
  • Listings must not be misleading through misstatement, omission, or ambiguous language.

2. Auction Management Responsibilities

  • Sellers are responsible for establishing fair-market value, starting bids, buy-now prices, and bid increments.
  • Sellers are responsible for opening auctions, setting close times, and communicating these clearly to bidders.
  • Any material changes to auction times must be communicated to all current bidders promptly.

3. Prohibited Bidding Practices

Sellers are strictly prohibited from placing bids, or causing bids to be placed, on any auction content for the purpose of artificially increasing or otherwise manipulating the bidding process ("shill bidding").

4. Changes During Active Auctions

Once an auction has opened and received bids, sellers should avoid making changes to listings. If a material misstatement is discovered after bidding has begun, corrections must be made immediately with direct notification to all current bidders.

5. Tax Responsibility

Sellers are solely responsible for determining applicable sales and use taxes and for the collection and remittance of those taxes to the appropriate governmental authorities. Handbid accepts no liability for any taxes owed on transactions. Sellers agree to indemnify Handbid against any claims, penalties, or costs arising from tax obligations related to their auctions.

6. Transaction Completion Obligations

Sellers must:

  • Complete transactions as described in their listings
  • Honor all contracts resulting from successful bids
  • Deliver items upon receipt of accepted payment
  • Accept payment upon a successful sale
  • Not materially misrepresent any item offered for sale

Failure to fulfill these obligations may be legally actionable and may result in account suspension or termination.

7. Legal Compliance

The Handbid Services may only be used for lawful purposes and in a lawful manner. You must comply with all applicable laws and regulations governing bidding, purchasing, charitable solicitations, and fundraising in the jurisdictions where you operate. At minimum, you must comply with the laws of the United States and the state in which the services are being used.

8. Account Security

  • You may not allow others to post content or conduct activity using your account.
  • Use of another person's account credentials without authorization is strictly prohibited.
  • You must keep your password secure and confidential and must not share account credentials.
  • You are solely responsible for all activity conducted under your password, regardless of who performs such activity.
  • Handbid is not liable for any losses or damages arising from compromised account activity.

9. Unauthorized Access Prevention

You must use reasonable security measures to prevent unauthorized access to your account. You must promptly notify Handbid in writing of any actual or suspected unauthorized access to or use of your account.

10. Service Interference

You may not interfere with the operation of the Handbid platform, any ongoing auctions, or other users' access to the service through the use of any device, software, virus, script, or other means, including auction sniping tools or automated scripts.

11. Performance Fee Avoidance

Commercial clients with performance-based fee arrangements are not permitted to sell products or services outside of Handbid with the intent of avoiding any performance fees due on purchases facilitated through the Handbid platform.

12. Restricted Use of User Information

Except as necessary to enter into and complete transactions, you may not use any information obtained about other platform participants for solicitation, advertising, unsolicited email, spamming, harassment, invasion of privacy, or any conduct inconsistent with Handbid's Terms of Service and Privacy Policy.

13. Prohibited Auction Content

You may not post, list, or make available any content or items through the Handbid platform that:

  • Is sexually explicit, contains nudity, or constitutes pornography
  • Creates a risk of harm, injury, emotional distress, death, disability, disfigurement, or illness to any person
  • Creates a risk of loss or damage to any person or property
  • Seeks to harm or exploit children in any way
  • Violates any applicable law or regulation
  • Is hateful, violent, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of privacy, harassing, threatening, libelous, profane, or otherwise objectionable
  • Is illegal, including the unauthorized disclosure of insider information or trade secrets
  • Infringes upon any intellectual property, privacy, publicity, or other personal or proprietary rights of any third party
  • You do not have the right to make available under applicable law or any contractual or fiduciary obligation
  • Is fraudulent, false, misleading, or deceptive

14. Prohibited Activities

You may not:

  • Use, display, mirror, or frame the Handbid service or any of Handbid's trademarks without express written consent
  • Access, tamper with, or use any non-public areas of the Handbid platform or systems
  • Probe, scan, or test the vulnerability of any Handbid system or network, or breach any security or authentication measures
  • Circumvent any technological protective measures on the platform
  • Access, search, scrape, or download content using automated tools, scripts, spiders, robots, crawlers, or data mining tools (other than Handbid-provided software or standard web browsers)
  • Send unsolicited spam, advertisements, promotional materials, junk mail, or chain letters
  • Use meta tags or hidden text containing Handbid's trademarks without express written consent
  • Use the platform for commercial purposes or for the benefit of any third party, except as expressly permitted
  • Forge TCP/IP packet headers or send any altered or deceptive source-identifying information
  • Decipher, decompile, disassemble, or reverse engineer any software underlying the Handbid service
  • Interfere with the access of any user, host, or network through the introduction of viruses, flooding, spamming, or mail-bombing
  • Collect or store personally identifiable information from other users without their express permission
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Violate any applicable law or regulation
  • Encourage or enable any other party to engage in any of the prohibited activities listed above

15. Enforcement

  • Handbid reserves the right to remove any content for any reason or no reason, including content that Handbid believes in its sole discretion violates this AUP or the Handbid Terms of Service.
  • Handbid may permanently or temporarily terminate or suspend any account, without notice and without liability, for any reason, including if Handbid determines in its sole discretion that a user has violated any provision of this Acceptable Use Policy or the Terms of Service.
